Function Booking Terms

TERMS AND CONDITIONS FOR FUNCTIONS AND MEETINGS
This document contains the terms and conditions which will apply to the booking of a function between yourselves and The Marquis of Cornwallis Ltd. (hereinafter called "the Company").
1 CONFIRMATION Upon verbal or written confirmation of a booking the company assumes the terms and conditions as described within are accepted whether this document has been signed or not. Once accepted a confirmed booking can only be cancelled or varied in accordance with these terms and conditions.
2 DEPOSITS The Company requires payment of a deposit before confirming any function booking. Payment of any deposit must be made at the time of a booking. Such a deposit will normally be calculated at the rate of £10.00 per person or full amount of any function room hire fee. However, The Company reserves the right to amend the amount of deposit required upon accepting a confirmed booking or upon agreeing any variation of it. The final bill will be issued on the day of the function, and any balance payable should be settled before departure.
3 CANCELLATIONS If you cancel your confirmed booking more than 7 days before the date of the event, the Company will refund your deposit in full. If the cancellation occurs within 7 days of the date of the function, the Company will charge a cancellation charge of 100% of the deposit or hire fee paid.
4 CHANGES TO THE DATE A change of date of the function will be treated by the Company as a cancellation, unless a new date is set immediately. The Company cannot make any commitment regarding availability of alternative dates for postponed or changed events.
5 VARIATIONS IN NUMBERS The Company requests that final numbers for an event are confirmed no less than 48 hours before the event. The final number confirmed will be the minimum number for which the cost per person is charged. Should the number of guests decrease within 48 hours of the event date, the full set menu price or an estimated spend per person will be charged.
6 DAMAGES AND SMOKING The Company reserves the right to charge for any damage caused by you or your guests during any function including damage caused by any decorations. We do not allow use of tape on our paintwork, table confetti or party poppers. Smoking is strictly forbidden within any of the function or inside areas. The company does not allow smoking under the canopy on our top terrace. Failure to comply will result in a £100 charge.
7 EVENTS OUTSIDE OUR CONTROL (Force Majeure) We will not be liable for any failure or delay in performing Our obligations where that failure or delay results from any cause that is beyond Our reasonable control. Such causes include, but are not limited to: power failure, internet service provider failure, strikes, lock-outs or other industrial action by third parties, riots and other civil unrest, fire, explosion, flood, storms, earthquakes, subsidence, acts of terrorism (threatened or actual), acts of war (declared, undeclared, threatened, actual or preparations for war), epidemic or other natural disaster, or any other event that is beyond Our reasonable control.
GOVERNING LAW AND JURISDICTION These Terms and Conditions, the Contract, and the relationship between you and Us (whether contractual or otherwise) shall be governed by, and construed in accordance with the law of [England & Wales] [Northern Ireland] [Scotland].
As a consumer, you will benefit from any mandatory provisions of the law in your country of residence. Nothing in above clause takes away or reduces your rights as a consumer to rely on those provisions.
Any dispute, controversy, proceedings or claim between you and Us relating to these Terms and Conditions, the Contract, or the relationship between you and Us (whether contractual or otherwise) shall be subject to the jurisdiction of the courts of England, Wales, Scotland, or Northern Ireland, as determined by your residency.
